Terms and Conditions

Trading Account Terms

  • The following terms and conditions apply to the exclusion of all other and any terms and conditions of the customer, which may be contrary to or inconsistent with these terms and such conditions shall not apply.
  • No goods or services will be supplied by AJKTIV Pty Ltd t/a Safety Supplies Direct Australia on any terms and conditions other than those set herein. The customer agrees by taking delivery of goods or services that the customer shall be deemed to agree to these terms and conditions and also to the exclusion of all others.
  • In an event where the customer trades outside these terms and conditions, Safety Supplies Direct Australia reserves the right to refuse to supply products and services to the customer, irrespective of whether an order has already been accepted or not, and Safety Supplies Direct Australia will not be liable for any loss or damage of any kind resulting directly or indirectly from such action.
  • Safety Supplies Direct Australia is not required to accept any goods or services from a customer and always reserves the right to suspend the supply of goods and services on credit without having to give a reason for its actions. (See Warranties and Returns)
  • Account Payments are due within 30 days of invoicing date. The customer will be liable for any costs incurred by Safety Supplies Direct Australia in the process of recovering any monies overdue, including but not limited to:
    • Interest
    • Bank Charges
    • Legal Fees
  • The title of ownership of any products sold by Safety Supplies Direct Australia shall not pass to customer until customer has paid Safety Supplies Direct Australia in full for these Goods. As such, the customer agrees that Safety Supplies Direct Australia personnel may enter a Customer site at any time to recover goods which are the subject of a recovery claim or payment dispute.
  • Customer will be deemed to have accepted goods as being in accordance with an order unless it notifies Safety Supplies Direct Australia via email otherwise within 7 days receipt of goods. Other than for defective goods where the customer notifies Safety Supplies Direct Australia of the defect, goods may only be returned to Safety Supplies Direct Australia within 10 days of the invoice date of the product. No goods may be exchanged or returned without permission by way of an official Return Authority from Safety Supplies Direct Australia. (see Warranties and Returns)
  • GST applies to all purchases.
  • AJKTIV Pty Ltd t/a Safety Supplies Direct Australia reserves the right to change these terms and conditions at any time. Should these terms change, we will notify the customer accordingly.

Placing Orders

  • The products included on safetysuppliesdirect.com.au are available for purchase online, via email or over the telephone with our Sales Team. Products are subject to availability and the customer will be advised should any availability issues apply to your order, with options for alternate product supply.
  • Should the Customer opt to use our online order system to place an order for Goods, the Customer agrees that all information by them in the online order is true and correct.
  • By placing an Order, either online, via email, or over the phone, the Customer agrees to inform Safety Supplies Direct Australia if there are changes to this information in any way, in a prompt and timely manner.
  • Safety Supplies Direct Australia reserves the right to withhold supply of products to the Customer including, but not limited to the below instances:
    • Safety Supplies Direct Australia has insufficient product to fulfil the order
    • the Goods ordered have been discontinued by the supplier/manufacturer/distributor
    • if the Customer has an account with Safety Supplies Direct Australia which is overdue for payment.

Pricing

  • Prices listed are in AUD and are subject to change.
  • All prices include GST, unless logged into our B2B ordering system which will itemise GST separately.
  • Specials and Promotion pricing is final. No further discounts, coupons or otherwise will apply to Special, Promotional or Clearance pricing.

Freight Charges

  • Metro area orders over $500 INCL gst attract free freight (FIS), otherwise a freight charge of $27.50 INCL GST will apply*
  • Regional area orders will be priced on a case-by-case basis, either manually or automatically via API.
  • Tracking will be provided at time of dispatch.

*High volume, pallet, bulk and regional orders may incur additional charges.

Deliveries

  • Delivery costs will be charged to the Customer, unless FIS / Free Freight order values are met**
  • Stocked items will be dispatched next day for any orders placed before 2pm (subject to availability)
  • SSD cannot deliver to PO Boxes
  • Delivery can take up to 5 days pending destination and carrier, but typically arrive within 24-48 hours after dispatch.
  • Anyone at the Delivery Address who receives the Goods shall be presumed by Safety Supplies Direct Australia or our Freight Carrier to be authorised to receive the Goods. A signature will be required in order to receive Goods in all cases.
  • If there is no-one at the Delivery Address when the Order is delivered, the Goods carrier may retain possession of the Goods and may:
    • A: Charge an additional delivery fee when attempting to redeliver the Goods.
    • B: Redirect the Goods to an alternate facility to enable pick up by the Customer.
  • The Customer will be notified in the event additional charges apply

**exclusions may apply for bulk or regional deliveries. Customers will be notified for approval prior to despatch should additional freight charges apply.

Warranties and Returns

  • All Products from Safety Supplies Direct Australia carry the manufacturer’s warranty, where applicable.
  • In the unlikely event you receive defective/faulty goods, please email our sales team to raise a Warranty Claim.
  • Standard Returns (returns other than defective/faulty Product) are at the absolute discretion of Safety Supplies Direct Australia, on approval and on a case-by-case basis, subject to but not limited to the below conditions;
    • only full, unopened carton quantity returns are accepted
    • restocking fee (20% or greater) may apply and will be advised for Customer approval prior to return authority being provided
    • customer is required to return goods via courier/AusPost at their own cost. Tracking is mandatory for any returned Goods consigned by the Customer. The Customer will forfeit credit values for any Goods lost in transit which are untraceable due to lack of acceptable tracking details
    • goods may only be returned to Safety Supplies Direct Australia initiated within 10 days of the invoice of the item. No goods may be exchanged or returned without permission by way of an official Return Authority from Safety Supplies Direct Australia, requested via email.

Disclaimer

  • Safety Supplies Direct Australia takes reasonable care in supplying personal protective equipment and other safety equipment based on information provided by the Customer. However, Safety Supplies Direct Australia is not responsible or liable for any loss or damage caused to person or property as a result of the Customer’s failure to seek professional advice from appropriate authorities or OH&S specialists before making a purchase from Safety Supplies Direct Australia.
  • Safety Supplies Direct Australia is not liable for any loss or damage whatsoever suffered by the Customer as a result of any act, omission or statement made by Safety Supplies Direct Australia, its employees, contractors, suppliers or agents whether negligent or not, or as a result of a delay or inability to deliver the Goods, except that nothing in these Terms limits any liability imposed by any statute, including, without limitation the Australian Consumer Law, unless or to the extent that it is lawful to do so.
  • The Customer indemnifies Safety Supplies Direct Australia against all loss, liability, cost (including legal costs on a full indemnity basis) and expense incurred by Safety Supplies Direct Australia in connection with any act or omission of the Customer including, but not limited to, negligence of the Customer or any unauthorised representation made or warranty given by the Customer in connection with the Goods; or as a result of any claim made or action brought in connection with the Goods or their use other than a claim or action brought by the Customer under these Terms or a condition or warranty implied by law which is not excluded by these Terms.
